In a deeply troubling case that has drawn widespread attention, a Delhi-based businessman, Puneet Khurana, tragically ended his life amidst an ongoing divorce, leaving behind serious allegations of mental torture and harassment against his wife, Manika Khurana. This incident has not only raised questions about the emotional toll of marital conflicts but also the legal implications of such allegations in India.

Background of the Incident

Puneet Khurana, a resident of Delhi’s Model Town, had been married to Manika for six years. Their relationship had been fraught with repeated disputes and disagreements, leading to their filing for divorce. On the day of his death, Puneet recorded a 59-minute-long video explaining his ordeal and the reasons behind his extreme step. According to his family, he was under severe distress due to alleged mental torture and threats from his wife.

In the video, Puneet accused Manika of making his life unbearable, even after they had ceased living together. His sister alleged that Manika explicitly encouraged him to end his life during one of their last conversations. Puneet’s family also pointed to financial disputes and unresolved issues involving approximately ₹1.35 crore between the two families.

Legal Framework in Cases of Suicide Linked to Harassment

When a person dies by suicide and leaves behind allegations of harassment or abetment, Indian law provides specific provisions to address such cases. In Puneet’s case, the following laws could be applicable:

Section 498A of the Indian Penal Code (IPC)

This section deals with cruelty by a husband or his relatives towards a wife. However, in reverse cases where the husband alleges cruelty, legal recourse can be sought under related provisions.

  • Definition of Cruelty: Any willful conduct likely to drive a person to suicide or cause grave injury to their mental or physical health.
  • Punishment: Imprisonment for up to three years and a fine.

Section 306 IPC – Abetment of Suicide

If evidence suggests that Manika’s actions instigated Puneet’s suicide, she could be charged under this section.

  • Punishment: Imprisonment for up to 10 years and a fine.

Section 503 and 506 IPC – Criminal Intimidation

  • Punishment: Imprisonment for up to seven years, a fine, or both, depending on the gravity of the intimidation.
